IP protection in Southeast Asia is fragmented. What works in Singapore won't necessarily work in Vietnam. Here's what tech founders need to know before market entry.

Trademark first, always

File trademarks in every market you intend to enter — before you launch. SEA has aggressive trademark squatters. We've seen multiple Australian companies forced to rebrand because their name was registered in Vietnam by a third party.

Patent reality

Patent enforcement in most SEA jurisdictions is slow and expensive. For tech startups, focus on trade secret protection, NDAs, and employment IP assignment rather than software patents.

Copyright basics

Copyright is automatic in all SEA jurisdictions, but enforcement requires registration in some. Vietnam strongly recommends registration for software copyright.

Cross-border data

Vietnam's data localisation requirements (Decree 53) require some data categories to be stored in-country. This catches many startups by surprise.

Cost expectations

Budget USD $4,000-$8,000 per market for initial trademark + key copyright filings. Underspending here costs an order of magnitude more later.
